Sajjan Hydrovac (hereafter referred to as "Sajjan Hydrovac" or the "Company") operates an advanced hydrovac slurry treatment facility located at 1400 The Queensway, Toronto, ON M8Z 1S4, Canada. Our process involves receiving hydrovac trucks at one of our four designated receiving bays, where the container is tipped to facilitate the disposal of the slurry material. During this process, the Customer's personnel are responsible for operating their equipment and must adhere to Sajjan Hydrovac's operating procedures, including our stringent health and safety policies. Our staff communicates these operating policies to customers prior to their utilization of our facility.
By utilizing the Sajjan Hydrovac facility, the Customer acknowledges that they do so at their own risk. The Customer assumes full responsibility for any damage to their property and accepts all liability associated with the use of our facility, including but not limited to liability for bodily injury or loss sustained by themselves, their employees, or subcontractors while on our premises, except in cases of gross negligence on the part of Sajjan Hydrovac. The Customer will be held accountable for any damage to the Sajjan Hydrovac facility resulting from their negligence or that of their personnel. Additionally, the Customer is responsible for maintaining commercial general liability insurance and WSIB coverage for their employees.
Sajjan Hydrovac, by providing this liability waiver and through the Customer's continued use of our facility, accepts the terms of use outlined herein and waives any claim for damages related to the use of our facility, except in instances where such damage is caused by the gross negligence of the Company.
